Federal Judge Orders Release of Abrego Garcia from Immigration Detention

A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks legal authority.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.

The situation stems from a erroneous removal to El Salvador in March, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling allegations, he was detained in federal detention.

In her order, the court noted that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
